1. Introduction

Welcome to Luxe Travelverse. These terms and conditions govern your use of our website and the services we offer. By accessing or using our website, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree to these terms, you must not use our services.

2. Definitions

  • “Client” or “you” refers to any individual using our services.
  • “We,” “us,” or “our” refers to Luxe Travelverse, a luxury lifestyle and travel company.

3. Booking and Payment

3.1 Booking Process:
All bookings must be made through our  authorized agents. A booking is confirmed when you complete the payments. It is your responsibility to check the accuracy of the booking details once you have received them and inform us immediately of any discrepancies.

3.2 Deposit and Payment:
A deposit is required at the time of booking to secure your reservation. The amount of the deposit and the payment schedule will be detailed in your booking confirmation. Full payment must be received prior to the commencement of the services as per the invoice details. Failure to make payment by the due date may result in the cancellation of your booking.

3.3 Payment Methods:
We accept payment by credit card, debit card, bank transfer, crypto, google pay, apply pay, binance pay or other payment methods as specified on our website. All payments must be made in the currency specified in the invoice.

4. Changes and Cancellations

4.1 Changes by You:
Any request for changes to a booking must be made in writing. While we will endeavor to accommodate your request, changes are subject to availability and any applicable charges. Significant changes, such as altering the travel dates or reducing the duration of stay, may be treated as a cancellation and rebooking.

4.2 Cancellations by You:
Cancellations must be made in writing. Cancellation charges will apply as detailed in your booking confirmation. The cancellation charges may include a percentage of the total booking cost, depending on the notice period provided prior to the commencement of the services.

4.3 Administration Fee:
No Administration Fee of £100 / AED 400 for registered members 

SECTION B: ADDITIONAL TERMS FOR PACKAGES

  1. Transferring Package Booking

Clause A:
If any member of your party is prevented from traveling on their package, they may transfer their place to someone else, subject to the following conditions:

  • The transferee satisfies all the conditions applicable to the travel arrangements.
  • You notify us in writing at least 7 days before departure.
  • You pay any outstanding balance, an administration fee per person transferring, and any additional charges arising from the transfer.
  • The transferee agrees to these terms and conditions.

Clause B:
Both you and the transferee will be jointly and severally liable for payment of all sums. This policy ensures that Luxe Travelverse can manage transfers efficiently and without financial loss.

  1. If You Cancel Your Package Due to Unavoidable and Extraordinary Circumstances

Clause A:
If unavoidable and extraordinary circumstances arise at your destination or its immediate vicinity, significantly affecting your package, you have the right to cancel before departure without paying a cancellation charge. These circumstances include, but are not limited to, war, natural disasters, and significant health risks.

Clause B:
Upon cancellation under such circumstances, Luxe Travelverse will provide a full refund of all monies paid but will not be liable to pay any additional compensation. This policy protects Luxe Travelverse from undue financial burden while ensuring client safety and satisfaction.

  1. If the Supplier/Principal Changes or Cancels Your Package

Clause A:
In the event of insignificant changes to your travel arrangements, Luxe Travelverse will inform you as soon as possible but will not be liable for any compensation. Insignificant changes include minor adjustments to flight times, changes in accommodation to another of the same or higher standard, and similar alterations.

Clause B:
For significant changes or cancellations by the supplier/principal, such as changes in accommodation to a lower standard, major itinerary changes, or changes in departure dates, Luxe Travelverse will offer you the choice of accepting the changes, receiving a full refund, or accepting alternative travel arrangements. This ensures that Luxe Travelverse can manage client expectations and maintain service quality.

  1. Insolvency Protection for Package Payments

Clause A:
Luxe Travelverse provides financial protection for all flight-inclusive packages through our ATOL number 3517. When you buy a flight-inclusive package, you will receive an ATOL Certificate outlining your financial protection.

Clause B:
For packages that do not include flights, financial protection is provided by our bond held with ABTA Ltd. This ensures that Luxe Travelverse clients are protected in the event of our insolvency, maintaining trust and confidence in our services.

5. Travel Documentation

5.1 Passport and Visa Requirements:
It is your responsibility to ensure that all necessary travel documents, including passports and visas, are valid and up to date. We will provide guidance on visa requirements; however, obtaining the necessary visas remains your responsibility. Failure to obtain the required travel documents does not constitute a valid reason for cancellation.

5.2 Health and Vaccinations:
Clients are responsible for ensuring they are fit to travel and have obtained any necessary medical advice or vaccinations. We recommend consulting with your healthcare provider well in advance of travel.

6. Health and Safety

6.1 Travel Insurance:
We strongly recommend purchasing comprehensive travel insurance that covers health, accidents, and loss. Your insurance should also cover trip cancellations and interruptions. Luxe Travelverse is not responsible for any losses or damages that occur during your trip.

6.2 Fitness to Travel:
It is your responsibility to ensure that you are physically fit to undertake the travel and activities booked. Any pre-existing medical conditions must be disclosed at the time of booking.

7. Accommodation and Services

7.1 Accommodation:
All accommodations are provided as per the booking confirmation. Special requests, such as specific room types or accessibility needs, must be communicated at the time of booking and are subject to availability. We cannot guarantee that all requests will be met.

7.2 Services:
Luxe Travelverse provides an array of exclusive services tailored to high-net-worth individuals. Our offerings include:

  • Lifestyle Manager: Personalized assistance to enhance your travel experience, from itinerary planning to on-the-ground support.
  • Luxury Unique Hotels & Boutique Hotels: Handpicked accommodations that provide unparalleled comfort and exclusivity.
  • Exquisite Cuisines at Michelin Star Restaurants: Reservations at world-renowned restaurants, ensuring a dining experience like no other.
  • 24 Hour Concierge: Around-the-clock assistance to meet your every need, ensuring a seamless and luxurious travel experience.

8. Liability

8.1 Third-Party Suppliers:
Luxe Travelverse is not liable for any injury, loss, or damage caused by third-party service providers. Our role is limited to arranging the services, and we do not assume any responsibility for the performance of these third parties.

8.2 Limitation of Liability:
Our liability is limited to the value of the services provided. We are not liable for any indirect or consequential losses, including loss of enjoyment, or any costs or expenses incurred by you.

9. Force Majeure

9.1 Definition:
We are not liable for any failure to perform our obligations where such failure is due to circumstances beyond our control, including but not limited to natural disasters, war, civil unrest, strikes, and other events classified as force majeure.

9.2 Consequences:
In the event of force majeure, we will make reasonable efforts to provide alternative arrangements. If this is not possible, we will offer a refund or credit for future services.

10. Governing Law

10.1 Jurisdiction:
These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom and the United Arab Emirates. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the United Kingdom and the United Arab Emirates.

11. Privacy Policy

11.1 Data Protection:
We are committed to protecting your privacy. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal data.

11.2 Use of Personal Information:
We will use your personal information to provide the services you have requested, to communicate with you, and to improve our services. We will not share your personal information with third parties except as necessary to provide the services or as required by law.

12. Amendments

12.1 Changes to Terms and Conditions:
Luxe Travelverse reserves the right to amend these terms and conditions at any time. Any changes will be posted on our website and will take effect immediately upon posting.

12.2 Continued Use:
Your continued use of our website and services following the posting of changes constitutes your acceptance of such changes.

13. Booking Conditions

13.1 Contract:
Your contract is with Luxe Travelverse. By requesting us to confirm your booking, you are accepting these terms and conditions on behalf of all persons named on the booking.

13.2 Special Requests:
We will endeavor to meet any special requests but cannot guarantee that they will be fulfilled. Special requests should be made at the time of booking.

13.3 Travel Advice and Vaccinations:
It is your responsibility to ensure that you are aware of all recommended vaccinations and health precautions in good time before departure. Health requirements and recommendations can change, and you should check the up-to-date position with your doctor in good time before departure.

13.4 Conduct:
You are expected to conduct yourself in an orderly and acceptable manner and not to disrupt the enjoyment of others. If in our opinion or in the opinion of any airline pilot, accommodation manager, or any other person in authority, your behavior is causing or is likely to cause distress, danger, or annoyance to any of our other clients or any third party, or damage to property, we reserve the right to terminate your booking arrangements with us immediately.

14. Complaints

14.1 Procedure:
If you have a complaint about any of the services provided by us, you must inform our representative or the supplier of the service immediately, who will endeavor to resolve the issue. If the problem cannot be resolved locally, you must write to our customer service department within 28 days of your return home, giving your booking reference and all relevant information.

15. Refunds

15.1 Conditions:
Refunds will only be made to the person who made the booking. Refunds will be processed within 14 days of receiving the cancellation notice.

Cancellation and Refund Policies

  1. Cancellation by the Client:

1.1 Cancellation Requests:

Clients may cancel their bookings at any time prior to departure. Cancellation requests must be submitted in writing via email to our customer service department. The cancellation request will take effect only once it is received by us.

1.2 Cancellation Charges:

Cancellation charges will apply based on the timing of the cancellation relative to the departure date. The charges are as follows:

  • More than 60 days before departure: 10% of the total booking cost.
  • Between 59 to 30 days before departure: 25% of the total booking cost.
  • Between 29 to 15 days before departure: 50% of the total booking cost.
  • Between 14 to 7 days before departure: 75% of the total booking cost.
  • Less than 7 days before departure: 100% of the total booking cost.

1.3 Non-Refundable Components:

Certain components of the booking, such as flight tickets, hotel bookings, and special services, may be non-refundable. These will be specified at the time of booking, and their cost will be excluded from any refund calculations.

1.4 Administration Fee:

In addition to the cancellation charges, an administration fee of £100 / AED 400 per passenger will be applied for Non Members to cover the costs of processing the cancellation.

  1. Cancellation by Luxe Travelverse:

2.1 Minimum Participant Requirement:

In rare cases, Luxe Travelverse may need to cancel a tour if the minimum number of participants required for the tour is not met. Clients will be informed of such cancellations at least 30 days before the scheduled departure date.

2.2 Alternative Arrangements:

If Luxe Travelverse cancels a tour, clients will be offered alternative travel arrangements of comparable standard. If the client chooses not to accept the alternative arrangements, a full refund of all monies paid will be provided.

2.3 Force Majeure:

Luxe Travelverse reserves the right to cancel any tour due to force majeure events (such as natural disasters, war, civil unrest, strikes, and other events beyond our control). In such cases, clients will be offered a full refund or credit for future travel, but no additional compensation will be provided.

  1. Refunds:

3.1 Refund Process:

Refunds will be processed within 14 days of receiving the cancellation notice. All refunds will be made to the original payment method used at the time of booking.

3.2 Refund Amounts:

The refund amount will be calculated based on the cancellation charges and non-refundable components outlined in section 1.2. Any applicable administration fees will also be deducted for Non Members.

3.3 Partial Refunds:

If only a portion of the booking is canceled, such as specific tours or services, a partial refund will be calculated accordingly.

3.4 Refunds for Packages:

For package bookings, the refund will be calculated based on the individual components of the package (e.g., flights, accommodation, tours) and their respective cancellation policies.

  1. Amendments to Booking:

4.1 Requesting Changes:

Clients may request changes to their bookings at any time. Changes are subject to availability and any applicable charges. Significant changes, such as altering travel dates or destinations, may be treated as a cancellation and rebooking.

4.2 Amendment Fees:

A minimum amendment fee of £100 / AED 400 per passenger will apply for any changes to the booking, in addition to any charges imposed by the service providers (e.g., airlines, hotels).

4.3 Non-Changeable Components:

Certain components of the booking, such as flight tickets and special services, may be non-changeable. These will be specified at the time of booking, and any changes will be subject to the terms and conditions of the service providers.

Unavoidable and Extraordinary Circumstances

Definition

Unavoidable and extraordinary circumstances refer to events or situations beyond the control of Luxe Travelverse or any service provider involved in your travel arrangements. These circumstances are typically unforeseeable and cannot be avoided even with all reasonable measures taken. They significantly impact the performance of travel services or the ability to travel safely.

Examples of Unavoidable and Extraordinary Circumstances

  1. Natural Disasters:
    • Earthquakes
    • Floods
    • Hurricanes
    • Volcanic eruptions
  2. Political Events:
    • War
    • Civil unrest
    • Acts of terrorism (and the threat thereof)
  3. Health Risks:
    • Significant outbreaks of serious diseases at the travel destination
    • Epidemics or pandemics (subject to current guidance and restrictions)
  4. Industrial Actions:
    • Strikes affecting essential services such as transportation and accommodation
  5. Government Actions:
    • Acts of any government or national authority, including changes in laws or travel restrictions
  6. Technical Issues:
    • Unavoidable technical problems with transportation

Impact on Travel Arrangements

  1. Cancellation by Luxe Travelverse:

If unavoidable and extraordinary circumstances arise, Luxe Travelverse may need to cancel your travel arrangements. In such cases:

  • You will be offered alternative travel arrangements if possible.
  • If alternatives are not feasible, you will receive a full refund of all monies paid.
  • Luxe Travelverse will not be liable for additional compensation as these events are beyond our control.
  1. During Travel:

If such circumstances occur during your travel:

  • Luxe Travelverse will provide prompt assistance, including information on health services, local authorities, and consular assistance.
  • We will assist in finding alternative travel arrangements if necessary.
  • However, we will not be liable for the costs of alternative arrangements or other assistance unless prior authorization is obtained.
  1. Financial Protection:

For packages that include flights, financial protection is provided by ATOL (Air Travel Organiser’s Licence). For non-flight packages, financial protection is provided by ABTA (Association of British Travel Agents).

Client’s Responsibilities

  1. Insurance:
  • It is strongly recommended to have comprehensive travel insurance that covers cancellations, health risks, and other potential issues.
  1. Compliance:
  • Clients are responsible for complying with any government travel advisories and health requirements related to their destination.

Limitations of Liability

Luxe Travelverse’s liability is limited in cases of unavoidable and extraordinary circumstances. The company will not be responsible for any injury, illness, death, loss, damage, expense, cost, or other claims that result directly or indirectly from these circumstances.

By including these provisions in our terms and conditions, Luxe Travelverse ensures transparency and prepares clients for unexpected events that may impact their travel plans. It also aligns with the legal requirements in both the UK and UAE, providing a robust framework for handling such situations.
